TERMS  While our regular terms are cash, we will be pleased to make credit arrangements with established concerns. Open accounts are payable 30 days from date of invoice. A late charge of 1-1/2% per month on the unpaid balance will be made on all past due accounts. Should this rate exceed the maximum rate that is lawful under the circumstances, that maximum rate shall apply. The maximum rate shall be governed by the law of the state of the buyer's designated billing office. Buyer also agrees to pay reasonable attorney's fees and other costs incurred at collection. No cash discounts will be allowed as it is our policy to maintain attractive prices consistent with high quality stock. First shipment is ALWAYS C.O.D.

CLAIMS  Shortages and damages enroute must be claimed at time of delivery and noted in detail on our delivery document. Failure to comply with the preceding voids any claims for credit. Damaged material or unacceptable stock must be returned to nursery on our truck. If stock is unloaded at your nursery or job site, no claims may be made and no credit given. Errors involving variance in grade, type, variety, species must be reported in writing to the offices within (5) five days after receipt of shipment. Valid claims will be processed immediately. However, we will at no time be responsible for more than the purchase price of the stock.

NON-WARRANTY Miller Tree Company will exercise care to have all plants true to name. Nevertheless, we give no warranty, expressed or implied, as to the variety or productivity of nursery stock we sell. Liability in all instances is limited to the purchase price. No liability is assumed by seller for delay or failure to deliver caused by wars, strikes, fires, floods, droughts, embargoes or any other contingencies beyond seller's control.

TRUCKING AND DELIVERY  Full truck loads will be charged at a rate of $2.50 per loaded mile. Multiple drops will be charge an additional $100.00 per drop. Less than full trucks will be combined with other shipments to same area. Freight will then be prorated to the percent of truck space taken up. Less than a full truck will also be charged a $100.00 drop charge.

Miller Nursery maintains its own fleet of trucks to better serve you. You may request the freight amount when you place your order. Customers are welcome to pick up orders at the nursery with a 48 hour prior notice. This will help us to assemble your order and load you out promptly.
